By using our website or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our website.

These Terms do not affect any legal rights you have as a consumer.

1. Using Our Website

You may use our website only for lawful purposes and in accordance with these Terms.

You must not:

  • use the website in a way that breaches any applicable law or regulation;
  • interfere with the operation, security or availability of the website;
  • introduce viruses, malware or other harmful material;
  • attempt to gain unauthorised access to the website, its servers or connected systems;
  • use automated tools to scrape, copy or collect content from the website without our prior written permission;
  • impersonate another person or provide false or misleading information; or
  • use our website to commit fraud or harm another person.

We may suspend or withdraw access to our website where reasonably necessary, including for maintenance, security or legal reasons.

2. Accounts and Customer Information

You may be able to create an account or place an order without creating an account.

Where you create an account, you must provide accurate, current and complete information. You are responsible for keeping your login details confidential and for all activity carried out through your account.

Please contact us promptly if you believe that your account or login details have been used without your permission.

You must be at least 18 years old to enter into a contract with us. If you are under 18, you may use our website only with the involvement and permission of a parent or legal guardian.

3. Our Products

We sell carefully selected secondhand, pre-owned and brand-new clothing, including items described as BNWT, NWOT or similar.

Many of our products are unique or available in limited quantities. As a result:

  • an item may be sold to only one customer;
  • we may not be able to offer an identical replacement;
  • product availability may change without notice; and
  • photographs, colours and appearance may vary slightly depending on your device and screen settings.

We aim to describe every product accurately, including its brand, size, condition, colour and any known imperfections. Because secondhand items have had a previous life, they may show signs of prior use. Any material flaw or significant imperfection known to us will be described in the product listing.

The condition, age, price and description of a secondhand item are relevant when assessing whether it meets the applicable legal standards. A defect that has been clearly brought to your attention before purchase, or which you should reasonably have noticed from the product description or photographs, may not amount to a breach of your statutory rights.

4. Product Descriptions and Images

We take reasonable care to ensure that product descriptions, measurements, photographs and prices are accurate.

However, minor differences may occur because:

  • colours can appear differently on different screens;
  • measurements may be approximate;
  • handmade, vintage or previously worn items may have natural variations; and
  • photographs may not show every minor feature of an item.

If you require further information about an item before ordering, please contact us using the details in Section 25.

5. Placing an Order

When you submit an order through our website, you are making an offer to purchase the products in your basket.

After you place an order, we will normally send an order acknowledgement confirming that we have received it. This acknowledgement does not necessarily mean that we have accepted your order.

A contract between you and us is formed when we send you an order confirmation confirming that the order has been accepted, or when we dispatch the products to you, whichever occurs first.

We may decline or cancel an order before acceptance where reasonably necessary, including where:

  • a product is unavailable;
  • there is an obvious pricing or description error;
  • we cannot verify the payment or delivery information;
  • we reasonably suspect fraud or unlawful activity; or
  • circumstances outside our reasonable control prevent fulfilment.

If we cancel an order after payment has been taken, we will refund the amount paid using the original payment method.

6. Prices and Payment

All prices are shown in pounds sterling (£), unless stated otherwise.

The total price of your order, including any applicable delivery charges, will be shown before you complete your purchase.

We may change prices at any time, but changes will not affect an order that we have already accepted, except where there is an obvious pricing error.

Payment must be made using one of the payment methods available at checkout. By submitting an order, you confirm that:

  • the payment information provided is accurate;
  • you are authorised to use the chosen payment method; and
  • you authorise us or our payment provider to take payment for the order.

Our payment providers may carry out security and fraud checks. Payment information is processed through the relevant payment provider and is not normally held directly by us. Further information about personal data is set out in our Privacy Policy.

7. Delivery

Our delivery arrangements, charges and estimated delivery times are set out in our Shipping Policy.

We currently ship within the United Kingdom only, unless we expressly agree otherwise.

We aim to dispatch orders within the processing time stated in our Shipping Policy. Delivery dates and times are estimates unless we have expressly agreed a specific delivery date with you.

We will deliver your order without undue delay and, unless a different period has been agreed with you, no later than 30 days after the contract is formed.

If delivery is delayed, please contact us so that we can investigate the position with the carrier. Nothing in these Terms excludes or limits your legal rights where goods are not delivered within the agreed period or within the period required by law.

Risk in the products passes to you when you, or a person nominated by you, physically receives them. Risk does not pass to you merely because we have handed the products to a delivery carrier.

8. Delivery Problems

Please check your order when it arrives and contact us as soon as reasonably possible if:

  • the parcel appears damaged;
  • an item is missing;
  • you have received the wrong item; or
  • an item appears defective or materially different from its description.

We will work with you to investigate and resolve delivery problems. This does not limit any rights or remedies available to you under applicable consumer law.

If you provide an incorrect delivery address, please contact us as soon as possible. We will take reasonable steps to help, but additional delivery charges may apply where an order has to be redirected or re-sent because incorrect information was provided by you.

9. Returns, Cancellation and Refunds

Our general returns process is set out in our Refund Policy.

If you are a consumer buying online, you normally have a legal right to cancel your order within 14 days after the day on which you, or a person nominated by you, receives the goods. You do not generally need to give a reason.

If your order is delivered in multiple parcels, the cancellation period normally runs from the day after you receive the final item.

To exercise this right, you should notify us clearly within the cancellation period by emailing glenn.robertson@twiceasnicethreads.co.uk. You must then return the goods without undue delay and normally within 14 days after notifying us.

You may handle the goods as reasonably necessary to establish their nature, characteristics and functioning. We may make a deduction from your refund for any reduction in value caused by handling beyond what is reasonably necessary.

Unless the goods are faulty, not as described or otherwise fail to meet your statutory rights, you are normally responsible for the direct cost of returning goods after exercising the change-of-mind cancellation right.

Where required by law, we will refund the standard delivery charge paid for the order. We do not have to refund any additional amount paid for an enhanced delivery option.

We will normally issue a refund without undue delay and no later than 14 days after the earliest of:

  • the day we receive the returned goods;
  • the day you provide evidence that you have returned the goods; or
  • the day we agree that you may keep the goods while receiving a refund.

Refunds will normally be made using the original payment method.

Some goods may be excluded from the statutory cancellation right where an applicable legal exception applies. If an exception applies, we will explain this in the relevant product information or when responding to your cancellation request.

10. Faulty, Misdescribed or Unsatisfactory Goods

Nothing in these Terms limits your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.

Goods supplied to consumers must, where applicable:

  • be of satisfactory quality;
  • be fit for any purpose made known to us;
  • match their description;
  • correspond with any sample or model shown; and
  • comply with other requirements imposed by applicable law.

If an item is faulty, not as described or otherwise fails to meet these requirements, you may have rights including repair, replacement, a price reduction or rejection of the goods, depending on the circumstances and applicable law.

For unique secondhand items, a replacement may not be possible. Where a replacement is unavailable or inappropriate, we will discuss the legally appropriate remedy with you.

The fact that an item is secondhand, reduced in price or marked as a sale item does not remove your statutory rights. However, an issue that was clearly disclosed to you before purchase may be taken into account when assessing whether the goods meet the required legal standard.

Please contact us promptly if you believe that an item is faulty or misdescribed. We may ask for photographs or other reasonable information to help assess the issue.

11. Consumer Rights

These Terms are intended to operate alongside, and not instead of, your statutory rights.

Nothing in these Terms will:

  • exclude or restrict liability that cannot lawfully be excluded or restricted;
  • exclude or restrict your rights under the Consumer Rights Act 2015;
  • prevent you from exercising your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; or
  • affect any other rights or remedies that you have under applicable consumer law.

If any provision of these Terms conflicts with a mandatory consumer protection law, that law will apply to the extent of the conflict.

12. Intellectual Property

All intellectual property rights in our website and its content, including our text, photographs, graphics, logos, branding, layout, product descriptions and other materials, belong to Twice as Nice Threads or our licensors, unless stated otherwise.

You may view, download or print reasonable extracts from our website for your personal, non-commercial use and for the purpose of considering or completing a purchase.

You must not, without our prior written permission:

  • copy, reproduce or republish substantial parts of our website;
  • use our photographs, product descriptions or branding for commercial purposes;
  • modify, distribute or create derivative works from our content;
  • remove copyright, trademark or other ownership notices; or
  • use our name, logo or branding in a way that suggests an association or endorsement.

Third-party names and logos appearing on our website belong to their respective owners. Their appearance does not imply that those businesses sponsor or endorse Twice as Nice Threads.

13. Reviews and Feedback

If you submit a review, comment, photograph, suggestion or other material to us, you confirm that:

  • it is accurate to the best of your knowledge;
  • you have the right to provide it;
  • it does not infringe another person’s rights;
  • it is not unlawful, abusive, threatening, misleading or obscene; and
  • it does not contain viruses or other harmful material.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and publish that material for the purpose of operating, improving and promoting our business.

We may moderate, refuse to publish or remove content where we reasonably believe it breaches these Terms or applicable law. We do not have to publish or retain any submitted material.

We will not alter a review in a way that changes its meaning, and we will not publish a review that we know to be fake or misleading.

14. Third-Party Services and Links

Our website may use or link to third-party services, applications or websites, including payment, delivery, analytics, social media and review services.

Third-party services are governed by the relevant provider’s own terms and privacy notices. We are not responsible for the content, availability, security or operation of third-party websites or services that we do not control.

A link to a third-party website does not amount to an endorsement or recommendation by us.

15. Shopify

Our store is hosted and powered by Shopify, which provides the online commerce platform that enables us to sell our products and services to you.

However, any sale or purchase made through our store is made directly between you and Twice as Nice Threads. Shopify is not responsible for the products we sell, the fulfilment of orders, returns, refunds, product quality or any other aspect of the transaction between you and us.

To the fullest extent permitted by law, you acknowledge that Shopify and its affiliates are not responsible for claims arising from or relating to products purchased from Twice as Nice Threads. Nothing in this Section limits any liability that cannot lawfully be limited or excluded, including liability owed to consumers under mandatory applicable law.

Shopify may collect and process personal information relating to your use of our store. Further information is available in our Privacy Policy and Shopify’s Consumer Privacy Policy.

16. Website Availability and Information

We aim to keep our website accurate, secure and available, but we do not guarantee that it will always be uninterrupted, error-free or free from viruses or other harmful material.

We may update, suspend, withdraw or change all or part of the website without notice where reasonably necessary.

Nothing in this Section affects your statutory rights relating to products purchased from us.

17. Liability

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for loss or damage that:

  • was not reasonably foreseeable;
  • was not caused by our breach;
  • results from your failure to follow reasonable care instructions or other instructions supplied with the product; or
  • results from events outside our reasonable control, subject to your statutory rights.

We do not exclude or limit liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory rights as a consumer;
  • defective products where liability cannot lawfully be excluded;
  • deliberate or reckless misconduct; or
  • any other liability that cannot lawfully be excluded or limited.

If you use our products for business or commercial purposes, different legal rules may apply and our liability to you may be limited to the extent permitted by law.

18. Events Outside Our Control

We will not be responsible for a delay or failure to perform an obligation where this is caused by an event outside our reasonable control.

Examples may include serious disruption to transport or postal services, natural disasters, fire, flood, epidemic, industrial disputes, government action, civil unrest, cyberattacks or widespread failure of telecommunications or payment systems.

Where an event outside our reasonable control affects your order, we will contact you where reasonably possible and take reasonable steps to reduce the impact.

This Section does not remove any legal rights you may have to cancel an order or obtain a refund.

19. Indemnity

If you use our website in breach of these Terms and that breach causes us loss, damage, liability or expense, you may be responsible for that loss to the extent permitted by law.

This Section does not apply to the extent that it would impose an unfair or unlawful burden on a consumer or conflict with your statutory rights.

20. Suspension and Termination

We may suspend or terminate your access to an account or our website where we reasonably believe that you have breached these Terms, acted fraudulently or unlawfully, or created a risk to us, our customers or our service providers.

Termination will not affect rights or obligations that arose before termination.

Sections that are intended by their nature to continue after termination, including intellectual property, liability, governing law and dispute provisions, will continue to apply.

21. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as removed or modified only to the extent necessary.

The remaining provisions will continue in full force and effect.

22. No Waiver

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

Any waiver must be expressly confirmed in writing.

23. Entire Agreement

These Terms, together with the policies expressly referred to in them, form the agreement between you and us concerning your use of our website and the purchase of products through our store.

Nothing in these Terms limits any information or promise that we are legally required to provide to you before entering into a consumer contract.

24. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, products, services or legal obligations.

The latest version will be published on this page with an updated date. Changes will not affect an order that we have already accepted unless the change is required by law or you agree to it.

25. Contact Information

26. Governing Law and Courts

These Terms and any contract between you and us are governed by the law of England and Wales.

If you are a consumer living in Scotland or Northern Ireland, you may also be entitled to rely on any mandatory protections available under the law of the part of the United Kingdom in which you live.

The courts of England and Wales will have non-exclusive jurisdiction over disputes arising from or relating to these Terms or a contract between you and us. This means that, where consumer law allows, you may also bring a claim in the courts of the part of the United Kingdom in which you live.
